These Terms of Service ("Terms") govern your use of Alera and all related services for individuals, including all associated software applications, technologies, and websites ("Services"). They apply to your personal, non-commercial use of our services as a consumer. You enter into an agreement with us when you confirm acceptance of these terms or when you use the services.
Our Terms of Service govern the use of Alera Enterprise, our APIs, and other services for companies and developers.
Our Privacy Policy explains how we collect and process personal data. Although it is not part of these terms, it is an important document that you should read.
Alera is a company dedicated to AI research and development in the field of psychology. Our goal is to provide people with AI-based, individualized psychological support before, after, and during therapy. You can learn more about Alera at alera.app/about.

Minimum Age. You must be at least 16 years old or the minimum age required in your country to use the services. If you are under 18, you must have parental or legal guardian consent to use the services and ask them to read these terms with you.
Registration. You must provide accurate and complete information to register for an account to use our services. You may not share your account details or allow anyone else to access your account, and you are responsible for all activities that occur under your account. If you create an account or use the services on behalf of another individual or legal entity, you must be authorized to accept these terms on their behalf.
What You Can Do. You can access and use our services as long as you comply with these terms. When using our services, you must comply with all applicable laws as well as the service-specific terms and policies listed above.
What You May Not Do. You may not use our services for illegal, harmful, or abusive activities. For example, you may not:
Software. Our services may allow you to download software, such as mobile applications, which may automatically update to ensure you are using the latest version. Our software may include open-source software, which is subject to its own licenses that we provide to you.
Company Domains. If you set up an account with an email address associated with an organization (e.g., your employer), this account may be added to the organization’s business account with us; in this case, we will notify you to assist with the transfer of your account (unless your organization has already informed you that they may monitor and have access to your account). Once your account is transferred, the organization’s administrator may control your account, including accessing content and restricting or removing your access to the account.
Third-Party Services. Our services may contain software, products, or services from third parties ("Third-Party Services"), and some areas of our services, such as our search function, may include output from these services ("Third-Party Output"). Third-Party Services and Third-Party Output are subject to their own terms, and we are not responsible for them.
Feedback. We welcome your feedback on our services, but you agree that we may use it to provide, maintain, develop, and improve our services without compensation to you.
Your Content. You may provide input for the services ("Input") and receive output from the services based on the input ("Output"). Input and Output are collectively referred to as "Content." You are responsible for the content, including ensuring that it does not violate applicable law or these terms. You represent and warrant that you have all rights, licenses, and permissions required to provide input for our services.
Content Rights. Between you and Alera, and to the extent permitted by applicable law, you retain (a) ownership rights to your input and (b) rights to the output. We hereby assign all our rights, title, and interest, if any, in and to the output to you.
Content Similarity. Due to the nature of our services and artificial intelligence in general, the output may not be unique, and other users may receive similar output from our services. Our assignment mentioned above does not extend to output from other users or Third-Party Output.
Our Use of the Content. We may use your content globally to provide, maintain, develop, and improve our services, comply with applicable laws, enforce our terms and policies, and keep our services secure.
Opt-out. If you do not want us to use your content to train our models, you have the option to prevent this by updating your account settings. For more information, please see this Help Center article. Please note that this may, in some cases, limit our services' ability to better address your specific use case.
Accuracy. Artificial intelligence and machine learning are rapidly developing fields. We are continually improving our services to make them more accurate, reliable, safe, and useful. Due to the probabilistic nature of machine learning, using our services may sometimes result in output that does not accurately reflect real people, places, or facts.
By using our services, you agree to the following:
We and our affiliates own all rights, title, and interest in the services. You may use our name and logo only in accordance with our trademark policies.
Paid Subscriptions. Some of our services offer you the option to purchase paid subscriptions to benefit from enhanced features and functionality ("Benefits"). The specific nature of the benefits varies from service to service and will be communicated to you before purchase. You can manage your paid subscription through your account settings.
Fees. All fees, including subscription fees, will be communicated to you before purchase.
Billing. If you sign up for a paid subscription or purchase a service, you must provide complete and accurate billing information, including a valid payment method. For paid subscriptions, we will automatically charge your payment method at each agreed-upon renewal period until you cancel. If your payment fails, we may downgrade your account or suspend your access to our services until the payment is received.
Right of Withdrawal. You are entitled to cancel your purchase and request a refund within 14 days from the purchase date without providing any reason (the "Cooling-Off Period"). The refund will cover the relevant subscription fee prorated from the date you cancel the contract until the end of the corresponding subscription period you paid for. To cancel and request a refund, please contact Support or complete the Model Withdrawal Form and send it to us.
Cancellation. After the cooling-off period, you may cancel your paid subscription at any time by updating your account settings. After canceling your paid subscription, you will not be charged any further. You will continue to have access to the benefits until the end of the subscription period you paid for; at that time, your cancellation will take effect. Unless otherwise stated, you will not receive a refund or service credit for the days between your cancellation date and the last day of the subscription period you paid for.
Changes. We may change our prices from time to time. If we increase prices for our subscriptions, we will notify you at least 30 days in advance, and any price increase will take effect upon your next renewal, allowing you to cancel if you disagree with the price increase.
Your Rights. You can terminate your use of our services and your legal relationship with Alera at any time by simply deactivating your account and stopping use of the services. You can find instructions for this here.
EU Consumer Right of Withdrawal. If you are an EU resident, you can deactivate your account and withdraw from these terms within 14 days of acceptance by contacting Support or completing the Model Withdrawal Form and sending it to us.
Alera’s Rights. We may take steps to suspend or terminate your access to our services or deactivate your account if we reasonably and objectively determine that:
Notice. If we deactivate your account, we will make reasonable efforts to notify you in advance so that you can export your content or data from the services unless it is inappropriate for us to do so, we have a reasonable belief that continued access to your account will harm Alera or others, or we are legally prohibited from doing so.
Appeals. If you believe that we have mistakenly suspended or deactivated your account, you may appeal to us by contacting Support.
How We Provide the Services. We commit to providing you with the services with reasonable skill and care and to act with professional diligence. We do not promise to offer the services indefinitely or in their current form for any specific period.
Liability. Provided we have acted with professional diligence, we assume no liability for losses or damages caused by us unless they:
We assume no liability for losses or damages caused by events outside our control. We do not exclude or limit our liability to you in any way where it would be unlawful to do so. You continue to enjoy the full protection of the laws applicable to you.
Legal Rights. You have certain legal rights that cannot be limited or excluded by contract or that you are entitled to under the law, e.g., because you are a consumer. These terms are not intended to affect or limit these rights in any way.
EU Consumer Rights. If you are an EU consumer, EU consumer protection laws provide you with a statutory guarantee for the services. If you have questions about your statutory warranty, please contact Support.
Concerns. In the event of a dispute, we would like to first understand and address your concerns before initiating formal legal action. To share your concerns, you can contact us via this form.
Court. If we cannot resolve our dispute, you or we may call on the court of your local jurisdiction.
Alternative Dispute Resolution for EU Consumers. If you are an EU resident, you may also submit the dispute to an alternative dispute resolution entity via the European Commission’s Online Dispute Resolution (ODR) platform, which you can find at https://ec.europa.eu/consumers/odr.
If you believe that your intellectual property rights have been violated, please send a notice to the address below or fill out this form. We reserve the right to remove or block allegedly infringing content and to deactivate repeat infringers' accounts.

Assignment. You are not allowed to assign or transfer any of your rights or obligations under this agreement. We may assign or transfer our rights or obligations under this agreement to an affiliate or subsidiary or a successor in interest to any business associated with our services. If we do, your rights as a consumer remain unaffected. If you are not satisfied, you have the right to end your legal relationship with Alera and stop using our services at any time.
Changes to These Terms or Our Services. We are continually working on developing and improving our services. We may update these terms or our services from time to time. For example, we may make changes to these terms or the services due to:
We will notify you at least 30 days in advance of any changes that significantly negatively affect you and the date they take effect, either by email or by in-product notice. All changes apply only to our future contractual relationship. If you disagree with the changes, you must stop using our services.
Delay in Enforcing These Terms. If we or you delay in enforcing a provision of these terms, either of us may enforce that provision later, and this does not prevent either of us from taking action against the other at a later date. If any part of these terms is declared invalid or unenforceable, it will not affect the enforceability of the other parts of these terms.
Trade Controls. You must comply with all applicable trade laws, including sanctions and export control laws. Our services may not be used in or for the benefit of (a) a country or region subject to a US embargo or (b) a natural or legal person with whom trade is prohibited or restricted by applicable trade laws. Our services may not be used for end uses that are prohibited under applicable trade laws, and your input must not contain materials or information requiring a government license to release or export.
Governing Law. These terms are governed by the laws of the country where you reside.
Commercial and Business Use. If you use our services for commercial or business purposes, the following terms apply. In the event of a conflict between this Business Use Addendum and the remaining terms, this Addendum prevails.
Limitation of Liability. NEITHER WE NOR OUR AFFILIATES OR LICENSORS WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, OR DATA, OR OTHER LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE THAT CAUSED THE CLAIM IN THE LAST 12 MONTHS BEFORE THE DAMAGE OCCURRED OR ONE HUNDRED EUROS (€100), WHICHEVER IS GREATER. THE LIMITATIONS IN THIS SECTION APPLY ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.
In some countries and states, the exclusion of certain warranties or the limitation of certain damages is not permitted, so some or all of the above terms may not apply to you, and you may have additional rights. In this case, these terms only limit our liability as far as permitted in your country of residence.
Alera’s affiliates, suppliers, licensors, and distributors are intended third-party beneficiaries of this Addendum.
Indemnification. If you are a business or organization, you agree to indemnify us, our affiliates, and our personnel, as far as legally permissible, from all costs, losses, liabilities, and expenses (including legal fees) arising from or in connection with your use of the services and content or a violation of these terms.
